Answer 10 questions to find out if you are ready to file your C100 application — and what you still need to do.
1.Have you attended a MIAM (Mediation Information and Assessment Meeting)?
A MIAM is required before filing a C100 unless an exemption applies.
2.Do you have a MIAM certificate or a valid exemption?
The mediator signs Section 3 of the C100. Without this, your application will be rejected.
3.Is this an urgent application (immediate risk to the child)?
Urgent applications can bypass MIAM but require strong evidence of risk.
4.Do you have full details of all children (name, DOB, address)?
The C100 requires full details of every child the application relates to.
5.Do you have the respondent's full name and address?
The court needs to serve the application on the respondent.
6.Are you clear on exactly which orders you are seeking?
You must specify whether you want a Child Arrangements Order, Prohibited Steps Order, or Specific Issue Order.
7.Have you considered the welfare checklist (s.1(3) Children Act 1989)?
The court's paramount consideration is the child's welfare. Addressing the checklist strengthens your application.
8.Are there any domestic abuse allegations in this case?
If yes, you may need to complete a C1A form alongside the C100.
9.Have you checked the court fee and whether you qualify for fee remission?
The C100 fee is currently £232. Use our Court Fee Calculator to check remission eligibility.
10.Have you prepared or started a position statement for the first hearing?
A position statement is expected at the First Hearing Dispute Resolution Appointment (FHDRA).
